The following matters are to be considered by the Windward Planning Commission of the County of Hawaii on Thursday, October 6, 2022 at 9 am.

In accordance with the provisions of Chapters 91 and 92, Hawaii Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawaii; and Planning Commission Rules of Practice and Procedure.

The public may provide written testimony via email at WPCtestimony@hawaiicounty.gov or submit by mail or in person at the Hilo Planning office at 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720 or at the Kona Planning office at West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii 96740 up to two business days prior to the hearing by 4:30 p.m.

Members of the public may provide public testimony regarding any agenda item now or at the time the agenda item is called to order.

NEW BUSINESS – 9:00 a.m.

1. APPLICANT: MAURICE & JIRANAN THOMAS TRUSTS (PL-SPP-2022-000017)
Application for a Special Permit to legitimize the use of an existing warehouse and office facility for warehousing, distribution and administrative operations related to retail and service activities in Orchidland Estates and Volcano Village on 1.045 acres of land in the State Land Use Agricultural district. The subject property is located at 16-1695 34th Avenue, at the southeast corner of its intersection with Orchidland Drive, Orchidland Estates, Puna, Hawaii, TMK: (3)1-6-009:385.

2. INITIATOR: COUNTY COUNCIL (BILL NO. 194)(PL-CCI-2022-000002)
An Ordinance amending Chapter 25, Article 2, Division 4, of the Hawaii County Code 1983 (2016 Edition, as amended), relating to conditions on change of zone actions. The purpose of this amendment is to clarify that the Planning Director may not extend the time allowed to satisfy conditions within a change of zone ordinance unless specifically authorized by the County Council.

Report on Special Management Area (SMA) determinations and minor permits issued by the Planning Director.

The Windward Planning Commission’s next monthly meeting is scheduled for Thursday, November 3, 2022 at the County Council Chambers in Hilo and the public can also testify via Zoom.

Pursuant to Hawaii Revised Statutes Section 92-7.5, the board packet provided to members of this board for this meeting is available for public inspection during regular business hours at the Hilo office of the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii and at the Kona office of the Planning Department, West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii.

Anyone who requires an auxiliary aid or service, other reasonable modification, or language interpretation to access this meeting, please contact the Planning Department at 961 8288 as soon as possible, but no later than five working days prior to the meeting date, to arrange for accommodations. “Other reasonable modification” refers to communication methods or devices for people with disabilities who are mentally and/or physically challenged.
