Hilo Judge Releases Puna Man Charged with Habitual OVUII / DUI, Driving with a Suspended License, and Inattention to Driving after a Traffic Collision

Prosecuting Attorney Kelden Waltjen announced that 33 year-old Replace Anres of Puna was arrested and charged for offenses related to habitually operating a vehicle under the influence of an intoxicant, driving with a suspended license, no insurance, and inattention to driving after a traffic collision at the intersection of Shower Drive and Kea‘au-Pahoa Road. According to police reports,

Anres, who was operating a Jeep Cherokee, rear-ended a Toyota 4-Runner that was at a complete stop within the left turn lane at the intersection. Anres later provided a breath sample indicating a 0.274 breath alcohol content.

Anres made his initial appearance in Hilo District Court on Monday afternoon. Over Prosecutors’ objections, the District Court judge released Anres, who was previously in custody on $53,000.00 bail, on supervised release and ordered him to appear for a preliminary hearing on September 4, 2024.

As the Complaint alleges, Anres is charged with Habitually Operating a Vehicle Under the Influence of an Intoxicant (“OVUII”), Operating a Vehicle after License and Privilege have been Suspended or Revoked for OVUII, No No-Fault Insurance, and Inattention to Driving. Prosecutors also alleged that Anres was a highly intoxicated driver because his measurable amount of alcohol was 0.15 or more grams of alcohol per two-hundred ten liters of his breath. Habitually Operating a Vehicle Under the Influence of an Intoxicant is a class C felony offense and carries either a penalty of a five-year prison term or five years probation and up to twelve months in jail.

The charges are merely allegations, and the Defendant is presumed innocent unless and until proven guilty.

The case was led by Officer Cody Correia, Puna Patrol, Hawai‘i Police Department. The case is being prosecuted by Deputy Prosecuting Attorney Brit Barker Pittullo.
