As the Complaint alleges, Costa was charged with a single count of Terroristic Threatening in the First Degree, a class C felony offense, carrying a maximum penalty of five (5) years in prison. A review of court records indicates that at the time of the alleged offenses, Costa was out of custody after posting bail in several unrelated matters. Costa is scheduled to make his initial appearance this afternoon in Hilo District Court. He remains in custody in lieu of $10,000.00 bail.
The investigation was handled by Officer Amy Omaya, Hawai‘i Police Department, South Hilo Patrol. The case is being prosecuted by Deputy Prosecuting Attorney Kevin Hashizaki.
The charges are merely allegations, and the Defendant is presumed innocent unless and until proven guilty.
