The Department of Health, State of Hawaii, Proposeʻs a Settlement Between the Department of Health and Hawaiian Electric Company, Inc

The Department of Health has issued a Notice and Finding of Violation and Order, in Docket Nos. 16-CA-EO-12, 17-CA-EO-07, and 18-CA-EO-02 for Hawaiian Electric Company, Inc. (HECO), Maui Electric Company, Ltd. (MECO), and Hawaii Electric Light Co., Inc. (HELCO), respectively, alleging that all 3 companies violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and Covered Source (CSP) Permit Nos. 0239-01-C, 0240-01-C, 0067-01-C, 0067-02-C, and 0007-01-C.

HECO, MECO, and HELCO failed to meet various Operational and Emissions limits. A Consent Order has been drafted that proposes to settle these cases. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice. (4/11/22)

The proposed Consent Order and the Notice and Finding of Violation and Order is also available on the Clean Air Branch, Department of Health’s website at http://health.hawaii.gov/cab.
