Waipi‘o Valley Road Emergency Rule No. 2 and Emergency Rule No. 1

Hilo, HI — The County of Hawai‘i has extended emergency rules for Waipi‘o Valley Road, ensuring continued safety and regulating access due to ongoing concerns over road conditions. These rules, which have been in place since September 15, 2022, are designed to protect public welfare, health, and safety in the Waipi‘o Valley area. Mayor C. Kimo Alameda has reaffirmed and extended Mayor’s Waipi‘o Valley Road Emergency Rule No. 2 and Emergency Rule No. 1, which are enforceable by law and effective until further notice.

The rules govern access to Waipi‘o Valley Road, and include provisions for road closures, exceptions for limited access, and restrictions during significant weather events or periods of construction. The measures are grounded in the authority granted by Hawai‘i Revised Statutes (HRS) Sections 264-1.5 and 127A-25(a).

The specific provisions of the continued emergency rules are as follows:

  1. Full Closure of Waipi‘o Valley Road:
    • Waipi‘o Valley Road remains closed to the general public, with the following prohibitions:
      • Pedestrian access is prohibited.
      • Uncovered vehicles, including ATVs, are banned from the road.
      • Horseback access is also prohibited.
  2. Limited Access Exceptions:
    • Certain groups are allowed limited access under strict conditions:
      • Hawai‘i County residents, licensed tour operators, and Native Hawaiians asserting traditional or customary rights.
      • Access is limited to low-range, four-wheel drive vehicles only (AWD vehicles are excluded).
      • Vehicle weight must not exceed 10,000 pounds, except for emergency vehicles or agricultural transport.
      • Passengers must be seated in enclosed compartments and wear seatbelts.
      • Makai-bound vehicles must yield to mauka-bound vehicles.
    • Licensed tour operators must obtain a permit from the Mayor’s office.
  3. Weather-Related Closures:
    • During significant weather events, as determined by the Hawai‘i County Civil Defense Agency in consultation with the Department of Public Works, Waipi‘o Valley Road will be closed to all use, or further access may be restricted.
  4. Closure During Construction:
    • The road may be closed or further restricted during periods of active repair or mitigation. Public meetings will be held to discuss road use planning during construction phases. Updates and information can be accessed through the Department of Public Works’ bulletin system.

This continuation of emergency rules is effective starting January 6, 2025, and is designed to manage risks associated with the road’s challenging conditions.
