Governor Green Signs Executive Order Protecting Medical Cannabis Caregivers

HONOLULU — In a significant move to support medical cannabis patients and their caregivers, Governor Josh Green, M.D., has signed an executive order to shield caregivers from enforcement actions as they cultivate cannabis for qualified patients under current laws.

The executive order comes in response to legal changes set to take effect on January 1, 2025, which could negatively impact caregivers and the patients they serve. Recognizing the potential health risks for patients, Governor Green directed the Department of Health (DOH) to prioritize resources away from enforcement against caregivers cultivating cannabis within the bounds of existing regulations.

“We have medical cannabis statutes to provide patients the relief each desperately need as they navigate very serious health issues,” Governor Green said. “We must protect the patients and their caregivers when the caregivers cultivate cannabis for a patient in a manner that fits squarely within the spirit of the medical cannabis law.”

The executive order ensures that primary caregivers can continue supporting patients without fear of enforcement, as long as they comply with the current medical cannabis framework and do not commit significant violations.

DOH Director Dr. Kenneth Fink expressed strong support for the Governor’s decision, stating, “The Hawaiʻi Department of Health strongly supports continuing to allow primary caregivers to cultivate medical cannabis for qualifying patients as needed for the patients’ health.”

Governor Green also called on the Legislature to address gaps in the law to provide a permanent solution that ensures caregivers can continue their essential role for patients in need.

The signed executive order is available for public review and highlights the administration’s commitment to protecting Hawai‘i residents relying on medical cannabis for serious health conditions.

This action reflects the Governor’s ongoing efforts to balance public health priorities with compassionate care for those facing critical health challenges.
